Description of Practice

Baltimore Mediation was established in 1993 by Louise Phipps Senft as the first mediation firm in the State of Maryland with all services from a transformative approach. For nearly twenty years, Ms. Senft has been in the day-to-day business of mediating interpersonal and multi-party disputes and facilitating divergent group dialogue, and providing the highest quality training and mentoring in conflict transformation and mediation. She is among the leadership in the profession and holds several public trainings annually on mediation and conflict transformation skills. Baltimore Mediation's emphasis is placed on quality dialogue as a pathway to common ground and greater understanding in relationship disputes. Along the way, problems get solved, healing occurs and parties gain clarity in decision making. That is the beauty of the transformative approach to conflict resolution and we specialize in making the conversation happen. Baltimore Mediation has assisted in thousands of conflicts and disputes in business and workplace relationships and in family relationships - including marital and separation & divorce, and many other situations.

Professional Background

Louise Phipps Senft began as a full-time mediator and trainer over 17 years ago when she left her corporate litigation law firm and launched the first mediation firm in Maryland. She has successfully mediated over 3,500 matters, has been named on multiple occasions one of the distinguished “Top 100 Women” in Maryland, has served on Governor’s task forces, has been a close advisor to Maryland’s highest court’s Chief Judge on ADR issues, is a national panelist with the American Arbitration Association and the Mid-Atlantic Region’s EEOC mediation panel, as well as the court appointed Chair and creator of Maryland’s Family Mediation initiative. She is a nationally certified mediator by the Institute for the Study of Conflict Transformation, as well as by the Maryland Council on Dispute Resolution, the only two performance-based certifications of skill level in the United States. She is an Advanced Practitioner Member, the highest designation of practitioner, with the national Association for Conflict Resolution. She also teaches at the University of Maryland School of Law, and designed the first mediation training course in 1996 which she continues to teach. She serves on the Board of Directors of the Global Negotiation Insight Initiative, an outgrowth of the think tank work at Harvard’s Program on Negotiation Insight Initiative, and is the Director of Training for Mediators Beyond Borders. She lives with her husband and five children in Baltimore, Maryland, and writes a monthly column for the state’s Daily Record on negotiation.

Approach

The approach referred to as "transformative" seeks to empower the parties involved by focusing mainly on interaction and communication between the participants. The main difference between this and other forms of conflict resolution or facilitation is that the transformative mediator's or transformative facilitator's goal is to foster the opportunities for clear decision making and a better understanding of the other person(s)' views, rather than to get the participants to agree or settle. While reaching agreement or settlement may still be the participants' goal, the mediator's interventions will focus on the quality of the interaction, with settlement or agreement being one of the many outcomes if so chosen by the participants. Other equally important and commonly experienced and reported outcomes are overcoming barriers to meaningful decision making, clarity about choices and next steps and a fuller understanding of a situation. The transformative mediator or facilitator assists the participants in designing their own rules and structure for a session, rather than the mediator imposing his/her own rules upon the participants. This helps to empower the participants.
